Contract

The Buyer shall provide the dog with adequate food, fresh water at all times, shelter, affection, love, and medical care, including all necessary shots and medication recommended by the veterinarian. The Buyer shall provide the dog with veterinary care upon sickness, disease, or injury, and shall take it to a veterinarian at least once a year for an annual health examination and routine vaccinations. The Buyer shall provide the dog with humane care and maintain it in accordance with all current and future state, county, and municipal laws and ordinances where the Buyer resides. The Buyer shall provide the dog with a fully fenced yard or other humane means of exercise. The dog shall not be kept constantly chained or constantly outdoors. The Buyer shall keep the dog as a household pet and shall never use it for breeding without the Breeder's consent or as an attack dog or guard dog. The Buyer shall provide a collar and identification tag for the dog to wear at all times when allowed to go outdoors. The dog shall reside at the Buyer's address. If the dog cannot be kept by the Buyer, the Buyer shall notify the Breeder immediately. The dog shall not be sold, transferred, or given to any individual or to any retail or wholesale establishment for the purpose of sale or resale to the public or to any research institution where medical experimentation or other practices take place. The Buyer agrees to take the puppy/dog to a veterinarian within three (3) days of the date of purchase for a physical examination to determine the health of the pup/dog. For pet-quality pups/dog, the Buyer agrees to have the bitch spayed before her first season at six (6) months old, or to have the dog neutered no later than nine (9) months of age or 6 months of age as long as both testicles have descended. The Buyer shall pay a purchase price as well as all shipping charges and related expenses with regard to the delivery of the puppy to the Buyer. The Buyer agrees that it is the Buyer's responsibility to accept the puppy as described. The Breeder has provided and the Buyer has acknowledged a full disclosure of the health, habits, and temperament of the puppy below. The Buyer agrees that the Breeder is in no way liable or responsible for any damage, accident, or injury resulting from the dog. The Buyer and Breeder agree to keep each other informed of their current addresses. The Buyer agrees to pay the Breeder any and all expenses, including court costs and reasonable attorney fees, in enforcing the terms and provisions of the Contract. Should the Buyer be unable or unwilling to fulfill any of the above provisions, the Buyer agrees to return the dog to the Breeder at the Breeder's request. Should the Buyer refuse to return the dog, the Buyer hereby authorizes the Breeder to pick up and remove the dog from the Buyer's control. To the best of JEMS knowledge the puppy/dog is free of hip dysplasia and hereditary eye defects. This warranty is to remain in effect until the dog is 24 months of age, unless the dog is bred before this time at which this warranty will become void.  To the best of JEMS knowledge the puppy/dog is not suffering from any communicable disease or congenital defect. That the puppy is in good health and current on all inoculations and wormings for the puppies age at time of sale. That if the puppy is a male, both testicles will descend by the age of 1 year. JEMS reserves the right to buy back the puppy/dog if for any reason the buyer is unable to keep the puppy/dog. JEMS gets first right off refusal, the price of the puppy/dog will be the same as or less that the original contract from JEMS. If the puppy/dog is in sound condition and has not been mistreated or abused JEMS has 30 days at their discretion to either buy the puppy/dog back or to find it a suitable home for the puppy/dog. THIS PUPPY MAY NEVER BE SOLD TO ANOTHER BREEDER.  A $500.00 deposit is required to hold/purchase a pup/dog; this is NON-REFUNDABLE, and NON-TRANSFERABLE.  Once deposit is agreed upon and received, buyer has 30 days to pay for puppy/dog in full and pick up their dog (8 weeks of age of puppy). If payment has not been received, the puppy/dog will go back up for sale and the deposit will not be returned. If dog is paid for in full and Buyer has not picked up their puppy/dog after 30 days (8 weeks of age for puppies), kennel fees of $10.00 per day plus fees for any shots required will be added and must be paid before buyer can pick up puppy/dog, at which point the buyer will relinquish their payments made and these are non-refundable and the dog will be placed in a different home. Buyer will be responsible to refund JEMS of any fees associated with returned checks. To include, bank fees, fees incurred due to returned check. Buyer will also pay JEMS a $100.00 return check fee which is not included in the bank fees. If this contract is violated there is a $5000.00 fee that must be paid to JEMS AUSSIES no later than 30 days after it has been deemed that the contract has been violated. As well as the return of the dog and all paperwork associated with the dog (testing results, vet records, registration papers signed over to the breeder etc.)
